Scene Terms and Conditions

Disclosure notice under s47A Fair Trading Act 1987 (NSW).

These Scene Terms and Conditions are important, and you should read them fully. However, there are some specific terms we wanted to make you aware of. These are set out below:

  • Clause 9: in some cases, Sony reserves the right to reject an Event registration.
  • Clause 10: some Events may require a degree of physical fitness. You are responsible for ensuring you are suitably dressed and physically capable to participate.
  • Clause 11: some Events organised through Scene may require you to sign a waiver or other legal form. These will be provided to you before the Event for review.
  • Clause 14: in accordance with your rights under the Australian Consumer Law, if an event is cancelled or there is a major change for the Event, you are entitled to a refund.
  • Clause 17: Scene allows you to post photographs from your attendance at an Event, subject to certain conditions being met.

About these Scene Terms and Conditions

  1. The following Scene terms and conditions (“Terms”) apply to your use of the Scene platform (https://scene.sonyanz.com/) (“Scene”), including but not limited to (1) all Scene events (“Event”) and (2) participating in the Community Gallery by sharing content on Scene. By registering for and participating in an Event, and / or sharing content on Scene, and / or continuing to use Scene, you indicate that you have read, understood and agree to be bound by these Terms.  These Terms operate in conjunction with Sony’s Website Terms of Use (https://store.sony.com.au/terms-and-conditions-of-sale.html) and Sony’s Privacy Policy (https://store.sony.com.au/privacy-policy.html).  In addition, information on Events, the registration process and any further criteria for participation in Events published by Sony and made available to you before deciding to participate in an Event, also form part of these Terms.
  2. A reference in these Terms to the singular includes the plural and vice versa.
  3. Where these terms refer to “Sony”, that means Sony Australia Limited (ABN 59 001 215 354) of Level 7, 73 Miller Street, North Sydney, NSW 2060 (Phone: (02) 9887 6666).
  4. The Host is any party other than Sony who publicises an Event through Scene

Representations and Warranties

  1. You represent and warrant:
    1. you have legal capacity and authority to enter into a contract on these Terms;
    2. you are at least 13 years old; and
    3. if you are under 18 years of age, your parent/guardian will also register for an Event and accompany you to Events.

Privacy and Consents

  1. Sony collects personal information, in the course of you registering on Scene and in organising Events. Sony may, in the course of organising Events, disclose such information to third parties, including but not limited to the Host and any secondary agents they may engage. You must provide this information to participate in Events. Please refer to the Sony Privacy Collection Notice (https://store.sony.com.au/privacy-collection-notice.html) and Sony Privacy Policy (https://store.sony.com.au/privacy-policy.html) for further information.
  2. You consent to Sony or its third party service providers using your details, including email address, to contact you regarding Events and other Scene related administrative purposes.
  3. You consent to Sony using your likeness, image and/or voice (such as photographs or video recordings) for the purpose of promoting Scene in any form or media, including online media such as Sony's official Facebook page and website. Please notify Sony or the Host if you do not wish to be photographed or filmed. You agree that you do not own any intellectual property in this content.

Events

  1. Sony reserves the right to reject an Event registration where:
    1. You are unable to materially comply with an essential term of these Terms which (if it is capable of remedy) cannot be remedied before the commencement of the Event;
    2. You have engaged in, or Sony reasonably suspects on the basis of available evidence that you have engaged in, fraudulent or other illegal activity; or
    3. it is necessary to protect Sony’s infrastructure, systems, data, security or assets and/or your personal information (for example where Scene and/or another Sony website is subject to a cyber incident or other unauthorised access).
  2. Some Events may require a degree of physical fitness. You are responsible for ensuring you are suitably dressed and physically capable to participate. By attending an Event, you are confirming that you are not under the effect of any medication or medical condition that will prevent you from safely participating.  If you are unsure of whether you can safely participate, please discuss with your Host ahead of time.
  3. Some Events organised through Scene may require you to sign a waiver or other legal form.  By purchasing a ticket to such an Event, you and any guests you purchase tickets for, agree to sign such documents as required by the Host and provided to you before participating in the Event, including but not limited to any legal release and indemnity form.
  4. Sony reserves the right to decline or remove any participant from an Event where their conduct is deemed to pose a risk or nuisance to others. The Host is empowered to act as proxy for such removal.
  5. Any costs you incur such as parking, internet fees, etc., that are not explicitly included in the cost of the Event as described, are at your own expense and not the responsibility of Sony or the Host.
  6. If an Event cannot proceed due to events outside of Sony’s control, then subject at all times to your rights under the Australian Consumer Law, Sony may need to alter or cancel the Event.  In such cases Sony will use reasonable endeavours to make contact with you prior to the commencement of the Event and provide suitable substitutions or compensation.  Under the Australian Consumer Law, if an event is cancelled, or has a major change (for example: the date changes or the location changes to one much further away) you are entitled to a refund.
  7. Unless the Host specifies otherwise, Event tickets purchased through Scene for single day Events are valid for anyone who holds the confirmation email. Once the Event ticket has been used, it cannot be used again.
  8. Event tickets purchased for multi-day Events are non-transferable, and must be purchased by the person or persons attending.

Sharing your content on Scene

  1. Scene allows you to post photographs taken from your attendance at an Event (which will appear in the “Community Gallery” section and other sections of Scene).   The following clauses apply to photos posted by you on Scene:
    1. Sony does not claim any ownership rights in the text, files, images, photos, video, sounds, musical works, works of authorship, applications, or any other materials (“Shared Content”) that you post on or through Scene.  By displaying or publishing any Shared Content on or through Scene, you hereby grant to Sony a non-exclusive, fully paid and royalty-free, worldwide, limited licence to use, modify, add to, delete from, publicly display, publicly perform, reproduce and translate such Shared Content, including but not limited to distributing part or all of the Shared Content in any media formats through any media channels for the sole purpose of promoting Scene.  Such promotion includes, but is not limited to EDM promotions and social media; and
    2. you represent and warrant that: (1) you own the Shared Content or otherwise have the right to grant the licence set out in this clause 17; (2) posting and use of the Shared Content does not violate the intellectual property rights (including copyright), privacy rights, publicity rights, contractual rights or any other rights of any person;
    3. the posting of the Shared Content on Scene does not result in a breach of contract between you and a third party;
    4. you agree to pay for monies owing to any person arising from the posting of the Shared Content, including but not limited to any royalties or fees; and    
    5. Sony reserves the right to remove any Shared Content which (1) is in breach of, or Sony reasonably suspects is in breach of, these Terms and Conditions; and/or (2) Sony reasonably suspects will bring Sony or its affiliates into disrepute.

General

  1. Sony reserves the right to change these Terms at any time in its discretion.  Where this involves a material change and/or it will have a significant impact on you, Sony will use its reasonable endeavours to provide you with notice of these changes on Scene.  Sony may not be able to provide notice where it needs to amend these Terms immediately.  For example: (a) because it is required by law to do so; (b) due to unexpected or operational issues beyond Sony’s reasonable control; (c) where it is reasonably necessary to protect Sony’s infrastructure, systems, data, security or assets and/or your personal information (for example where Scene or another part of Sony’s operations is subject to a cyber incident or other unauthorised access) or (d) it is reasonably necessary for Sony to comply with a legitimate contractual obligation.    
  2. Nothing in these Terms limits, excludes or modifies or purports to limit, exclude or modify, the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia ("Non-Excludable Guarantees"). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, Sony, (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence) for any personal injury or any loss or damage (including loss of opportunity) - whether direct, indirect, special or consequential - arising in any way out of the promotion, including (without limitation): (a) any technical difficulties or equipment malfunction (whether or not under Sony's control); (b) any theft, unauthorised access or third party interference.
  3. These Terms are governed by the laws of New South Wales. You agree to submit to the non-exclusive jurisdiction of the courts of New South Wales and the Federal Court of Australia and any courts that may hear appeals from those courts about any proceedings in connection with the Event or these Terms.
