| Disclosure Notice in accordance with section 47A of the Fair Trading Act 1987 (NSW) These Terms and Conditions are important and you should read them fully. But there are some specific terms we wanted to make you aware of. These are set out below. Clause 7: Sony reserves the right to vary, modify, limit or cancel the Benefits commencing on the start of the next calendar year. Sony will use its reasonable endeavours to notify you about such changes by prior notice on the Scene website and/or to your Scene registered email address. Clause 13: Sony may terminate Scene Rewards at any time by providing 6 months’ notice. Sony will use its reasonable endeavours to provide you with this notice through the Scene website and to the email address registered in your Scene account. All Benefits will remain available during the notice period, and any Benefits received during or before the notice period will remain valid in accordance with their time for use, and will be subject to the terms applying to them at the time they were issued / utilised. |
Introduction
Below are the terms and conditions for Scene Rewards. Scene Rewards is a benefits program where you earn points based on attending Scene events and other incidental ways to earn points.
About these Terms and Conditions
- In these Terms and Conditions (Terms):

- “Business Day” means any day that is not a Saturday, Sunday or public holiday in (a) any state of Australia (for Australian residents) or (b) New Zealand (for New Zealand residents).

- “Event” has the meaning given to the Term in the Scene Terms and Conditions:

- “Points” means points earnt as part of Scene Rewards in order to obtain Benefits, as described more fully in clause 6.a).

- “Scene” means Sony’s platform designed to connect creators, photographers, filmmakers, and digital imaging enthusiasts through hosted events, competitions, a community photo sharing gallery, and other features, as currently located at the Website;

- “Scene Account” means a Scene account created to join Scene;

- “Scene Rewards” means the benefits program described in these Terms;

- “Scene Terms and Conditions” means the terms and conditions for Scene available at https://scene.sonyanz.com/additional-pages/terms-and-conditions;

- “Sony” is a reference to Sony Australia Limited (ABN 59 001 215 354) of Level 7, 73 Miller Street, North Sydney, NSW 2060;
-
- “Tier” means the Bronze, Silver and Gold tiers within Scene Rewards;
-
- “Website” means the website for Scene currently located at https://scene.sonyanz.com/ and any other future website for Scene;

- “You”, “Your”, “Scene Members” is a reference to a person entitled to access and participate in Scene Rewards; and
-
- the singular includes the plural and vice versa.
Participating in Scene Rewards
- You begin participating in Scene Rewards when Your Scene Account is created.
- There is no activation or other step required to start participating in Scene Rewards.
- You can view the Benefits You are entitled to at any point in time by accessing Your Scene Account.

* Redeemable once 1000 points are reached in a membership year, maximum of one (1) Sony Merchandise Pack can be redeemed per membership (calendar) year. ** Once Gold Tier is reached, this 50% discount is the total discount, and is not cumulative with the 25% Silver Tier discount (so it is not 75%). *** Maximum of $40 savings per transaction per event. |

- Points expire every year and reset to zero (0) for the following year. However, once You have achieved a Tier as at the end of a calendar year, this Tier status is maintained for the following calendar year. You must accumulate Points again within that Tier to maintain Your membership Tier and its associated benefits. Failure to maintain the Points required to remain in that Tier will result in You going to the eligible Tier based on the Points you acquired within that calendar year (reference table in clause 5). Alternatively, if the amount of Points required to achieve the next Tier up is achieved in that calendar year then You will move to that higher Tier. Please refer to the Appendix which shows these conditions diagrammatically.

- it may take up to 3 Business Days for Points that You have earnt to appear in Your Scene Account;

- For the Sony merchandise pack for Silver Tier;

- upon achieving 1000 Points for Silver Tier, the user dashboard in your Scene account will display a “Free Sony Merch Pack” window; and
-

- upon clicking “Redeem now”, You will be taken to a new window to choose Your merchandise pack and enter Your delivery details (note: unless stock of one has run out, there are 2 merchandise packs to choose from). Packs will take up to 30 days for processing and delivery.

- discounts on eligible Scene-Hosted events and Sony-Hosted events on Scene for Gold and Silver Tiers is automatically applied during the booking check out process;

- if You are Gold Tier or Silver Tier, You are automatically entered into the Monthly Sony Store Voucher Draw (2 entries for Gold Tier members). The winner is notified within 5 Business Days from the end of each month; and
-
- Gold Tier members will receive at least three (3) invitations to VIP talks from Sony Ambassadors, Advocates and/or Friends of Sony.
- Sony reserves the right to vary, modify, limit or cancel the Benefits commencing on the start of the next calendar year. Subject to clause 8 below, Sony will use its reasonable endeavours to notify You about such changes by prior notice on the Website and/or to Your Scene registered email address. In the unlikely event that during a calendar year, Sony can no longer provide a particular Benefit, a substitute benefit of equal or greater value will be provided. Benefits will remain available and unchanged during the relevant notice period, and any Benefits received during or before the notice period will remain valid for their time of use set out in clause 5 and in accordance with the terms applying at the time they were accessed / used.
Termination
- Sony may, in its discretion, suspend, change or terminate Your participation in Scene Rewards and/or receiving the Benefits, where:

- You have engaged in, or Sony reasonably suspects on the basis of available evidence that You have engaged in, fraudulent or illegal activity relating to Scene Rewards and/or the Benefits;

- You have created, or Sony reasonably suspects that You have created, multiple Scene Accounts;
-
- You have provided misleading information in connection with Your Scene Account;
-
- You materially breach an essential Term which cannot be remedied;
-
- You materially breach an essential Term and (i) fail to remedy the breach within 10 days of receiving written notice (including over email) from Sony to do so or (ii) having commenced action to remedy the breach, fail to complete that action as soon as possible and in any event within 20 days of receiving written notice (including over email) from Sony to do so; or
-
- it is reasonably necessary to protect Sony’s infrastructure, systems, data, security or assets and/or Your personal information (for example where the Website and/or Scene Rewards is subject to a cyber incident or other unauthorised access).
- Where Sony intends to terminate Your participation in Scene Rewards, Sony will use its reasonable endeavours to provide You with written notice of this proposed termination to the email address registered to Your Scene Account, and You will have 14 days to advise Sony in writing as to why Your Account should not be terminated. Sony will take into consideration any response You provide and advise You of its decision. Your Account will be not be accessible during this 14-day period. Sony reserves the right to immediately terminate Your participation in Scene Rewards without giving You the 14 day notice period referred to above where (a) Sony is required by law to do so or (b) where it is reasonably necessary to protect Sony’s infrastructure, systems, data, security or assets and/or Your personal information (for example where the Website and/or Scene Rewards is subject to a cyber incident or other unauthorised access).
- Any fraudulent or illegal activity may be subject to appropriate administrative and/or legal action by Sony, including providing Your personal information to law enforcement authorities where Sony is required to do so.
- You may terminate Your participation in Scene Rewards at any time by terminating Your Scene Account. At this time all Benefits are forfeited. If You wish to create a Scene Account again in future, You will start with zero (0) Points at Bronze Tier.
- Sony may terminate Scene Rewards at any time by providing 6 months’ notice. Sony will use its reasonable endeavours to provide You with this notice through the Website and to the email address registered in Your Scene Account. All Benefits will remain available during the notice period, and any Benefits received during or before the notice period will remain valid in accordance with their time for use, and will be subject to the terms applying to them at the time they were issued / utilised. In some limited cases, Sony may need to terminate Scene Rewards without providing at least 6 months prior notice. For example: (a) where Sony is required by law to do so; (b) due to unexpected or operational issues beyond Sony’s reasonable control or (c) where it is reasonably necessary to protect Sony’s infrastructure, systems, data, security or assets and/or Your personal information (for example where the Website and/or Scene Rewards is subject to a cyber incident or other unauthorised access). In these cases, Sony will give You as much notice as reasonably possible in the most suitable way at the time.
General
- Sony will collect, handle and store any personal information collected pursuant to these Terms in accordance with the Privacy Collection Notice and Privacy Policy You consented to at the time for creating Your Scene Account. Please see here and here.
- A failure or delay by either Sony or You in exercising rights under these Terms does not constitute a waiver of those rights.
- Nothing in these Terms affects any rights You may have and which by law cannot be excluded, including under the Australian Consumer Law (Australian residents) or Consumer Guarantees Act 1993 (NZ) and Fair Trading Act 1986 (NZ) (New Zealand residents).
- Australian residents: These Terms are governed by and will be construed in accordance with the laws of New South Wales, Australia. You submit to the non-exclusive jurisdiction of the courts of NSW and the Commonwealth with respect to any action or other legal process with respect to any matter in connection with these Terms. New Zealand residents: These Terms are governed by and will be construed in accordance with the laws of New Zealand. You submit to the non-exclusive jurisdiction of the courts of New Zealand with respect to any action or other legal process with respect to any matter in connection with these Terms.
- If any part or all of any clause in these Terms is illegal, invalid or unenforceable then it will be read down to the extent necessary to ensure that it is not illegal, invalid or unenforceable, but if that is not possible, it will be severed from these Terms and the remaining provisions of these Terms will continue to have full force and effect.
- Except in the case of the process for changes to the Benefits (see clause 7) or termination of Scene Rewards (see clause 13), Sony may vary these Terms from time to time in its discretion. Where this involves a material change and/or it will have a significant impact on You, Sony will use its reasonable endeavours to provide You with prior reasonable notice of these changes at the Website and/or to Your registered email in Your Scene Account. Sony may not be able to provide such notice where Sony needs to amend the Terms immediately. For example, where (a) Sony is required by law to do so; (b) due to unexpected or operational issues beyond Sony’s reasonable control or (c) where it is reasonably necessary to protect Sony’s infrastructure, systems, data, security or assets and/or Your personal information (for example where the Website and/or Scene Rewards is subject to a cyber incident or other unauthorised access).
- If You continue participate in Scene Rewards after the changes have taken effect, You are deemed to have accepted these changes.
